NavTrail — Terms of Service

These terms govern your use of the NavTrail mobile app and the navtrail.app website (together, the "Service"). By using the Service, you agree to them. If you do not agree, please do not use the Service. A Romanian version is available at /terms-ro.

1. Who provides the Service

NavTrail is operated by Constantin, an individual developer based in Bucharest, Romania. It is a hobby / non-commercial project; there is no registered company behind it at the time of writing. Contact: contact@navtrail.app.

2. The Service is free

NavTrail is provided free of charge. No account, name, email, or phone number is required to use the app. We may add optional paid features in the future; if we do, their terms and price will be shown clearly before any purchase.

3. License

You are granted a personal, non-exclusive, non-transferable, revocable license to use the Service for lawful, personal off-road and overlanding navigation. You may not resell, redistribute, reverse-engineer for malicious purposes, or use the Service to build a competing dataset by bulk-scraping community content.

4. SAFETY — read this

NavTrail is a navigation aid, not a safety system. It is provided "as is", with no guarantee of accuracy, availability, or fitness for any purpose.

• The community SOS feature is NOT a replacement for official emergency services. In a real emergency, always call 112 (or your local emergency number) first. SOS alerts depend on other users being nearby, online, and willing to help — none of which is guaranteed.
• Maps, routes, offline data, hazard reports, points of interest, soil/weather indicators, and the off-road dashboard (inclinometer, barometer) may be inaccurate, outdated, or incomplete. Do not rely on them as your sole source of decision-making.
• You are solely responsible for your own safety, your vehicle, your passengers, your route choices, and for obeying all laws, land-access rules, and private-property restrictions. Off-road driving is inherently risky.
• Always carry independent means of navigation and emergency communication.

5. Community content

Users can add points of interest and hazard reports. You are responsible for the content you submit; submit only accurate, lawful, non-offensive information. By submitting content you grant us a non-exclusive, worldwide, royalty-free license to display and distribute it within the Service to other users. We may moderate, edit, or remove content — see the Moderation Policy. Do not submit false hazard or SOS reports; doing so may endanger others and will result in removal.

5.1 Travel partners

The travel-partners board lets you post a planned trip and lets other users ask to join it, or lets you ask to join theirs. By using it you agree that:

• You are 18 or older. Posting a trip or asking to join one requires an explicit declaration to that effect.
• Trips are free. Nobody may ask for, offer or accept payment for a trip or a seat through the Service. Listings that ask for money are removed. How you split fuel or camp costs among yourselves, outside the Service, is your own business.
• Contact details belong in the conversation, never in a public listing or a request. What you share there — for example your phone number — you share by your own choice, with one person.
• Meeting and travelling with people you met through the Service is at your own risk. We do not verify identities, driving skills, vehicles, equipment or intentions, and we are not a party to any arrangement you make. Meet in a public place first, tell someone where you are going and when you will be back, and leave at any time.
• Ratings must describe a trip you actually took together. Abusive or misleading listings, messages or ratings will be removed and may end your access to the board. See the Moderation Policy.

5.2 Comments, ratings, badges and following

• Comments and ratings must be honest and about the point of interest or route they are attached to. No harassment, no advertising, no contact details, and no rating of your own items.
• Badges are earned only by using the app as intended: a recording faked with a mock location, or a route that was not actually driven, earns nothing and may cost the badge and the account.
• Following is one-way and public in numbers only. Do not use comments or follows to pursue someone who blocked you.
• Abusive or misleading comments and ratings will be removed and may end your access to these features. See the Moderation Policy.

6. Acceptable use

You agree not to: misuse the SOS or hazard features; harass other users; upload unlawful, infringing, or harmful content; attempt to disrupt, overload, or gain unauthorized access to the Service or its backend; or use the Service in any way that violates applicable law.

7. Your data

NavTrail is privacy-first and uses anonymous sign-in. How we handle data is described in the Privacy Policy. You can request deletion of your data at any time — see Delete your data.

8. No warranty

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, property, injury, or harm arising from your use of (or inability to use) the Service — including reliance on its navigation, maps, hazard, or SOS features. Nothing in these terms excludes liability that cannot be excluded under applicable law (including liability for death or personal injury caused by gross negligence). As a free, non-commercial project, any aggregate liability is limited to the maximum extent the law allows.

10. Changes & termination

We may update the Service or these terms. Material changes will be reflected by a new effective date on this page. We may suspend or discontinue the Service, or restrict access for users who breach these terms, at any time.

11. Governing law

These terms are governed by the laws of Romania and applicable EU law. Mandatory consumer-protection rights in your country of residence are not affected.
